These terms govern your use of mindiam.com (the “Site”) and services provided by Mindiam (ABN 50 797 437 657). By using the Site you agree to these terms. If you don't agree, please don't use the Site.
1. Editorial content
Articles published on mindiam.com are editorial opinion based on published research, primary sources, and (where disclosed) the author's direct experience. Every claim links to its source. Content is provided “as is” for informational purposes - you should verify facts against the cited primary sources before making business or financial decisions. We don't guarantee outcomes from following editorial advice.
2. Affiliate links
Some articles include affiliate links - Mindiam earns a commission when readers sign up with linked vendors. We disclose these in line with ACCC guidance and within each article. Affiliate relationships do not influence editorial verdicts; we recommend products on merit and disclose hidden costs honestly. Full terms in our affiliate disclosure.
3. Consulting engagements
Consulting work is governed by a separate engagement letter signed before work commences. The engagement letter sets scope, deliverables, AUD pricing, payment terms (Xero invoicing, 14-day NET unless agreed otherwise), and intellectual-property terms. The Site itself does not constitute a binding offer for consulting services - bookings via Reclaim.ai are introductory calls only.
4. Newsletter + lead magnets
Subscribing to the newsletter or downloading a resource means you opt in to receive related editorial content from Mindiam. You can unsubscribe at any time via the link in every email - honoured within 1 hour, not the legal 5-business-day maximum. We follow the Spam Act 2003 strictly; we don't buy or rent lists.
5. Intellectual property
Editorial content (articles, design, code) is © Mindiam unless another author is credited. You may quote up to 100 words for commentary or review with full attribution + a link back to the original. Wholesale republishing without written permission is not permitted. AI training on Mindiam content without explicit permission is prohibited; we reserve all rights under the Copyright Act 1968 (Cth) and the AI-training-prohibition signal at /.well-known/ai-policy.
6. Liability
To the extent permitted by law, Mindiam is not liable for indirect, incidental, or consequential damages arising from your use of the Site or reliance on editorial content. Australian Consumer Law guarantees that cannot be excluded still apply. For consulting work, liability is governed by the engagement letter.
7. Third-party links
We link to external sites for citations, tools, and primary sources. We don't control those sites and aren't responsible for their content, accuracy, or availability. Visiting a linked site is at your own discretion.
8. Governing law
These terms are governed by the laws of New South Wales, Australia. Disputes are resolved in NSW courts unless mutually agreed otherwise.
9. Updates
We update these terms when needed. Material changes are announced via the newsletter. Continued use of the Site after an update constitutes acceptance.
